OverAssessed provides property tax assessment analysis and protest services for residential and commercial properties in Texas. Our services include:
- Property assessment analysis and valuation review
- Filing property tax protests with county appraisal districts
- Representation at informal hearings
- Preparation of evidence packages and supporting documentation
3. Fee Structure
Our fees are contingency-based, meaning you only pay if we successfully reduce your property tax assessment. Our standard fee is 25% of the first-year tax savings achieved. No upfront costs or hidden fees.
4. Your Responsibilities
You agree to:
- Provide accurate and complete property information
- Respond promptly to requests for documentation or information
- Allow reasonable access to your property if needed for valuation
- Not engage other representatives for the same tax year without notifying us
5. Representations and Warranties
You represent and warrant that:
- You are the legal owner or authorized representative of the property
- All information provided is true and accurate
- You have the authority to engage our services
6. Limitation of Liability
OverAssessed's liability is limited to the fees paid for our services. We are not liable for:
- Indirect, incidental, or consequential damages
- Lost profits or business opportunities
- Actions or decisions by county appraisal districts
- Market conditions affecting property values
7. No Guarantee of Results
While we strive for the best outcomes, we cannot guarantee specific results. Property tax protests depend on various factors including property conditions, market data, and appraisal district policies.
8. Termination
Either party may terminate the service agreement with written notice. Upon termination:
- You remain responsible for fees on completed work
- We will return any documents provided by you
- Our confidentiality obligations continue
9. Privacy and Confidentiality
We maintain strict confidentiality of your property and personal information in accordance with our Privacy Policy.
10. Governing Law
These terms are governed by the laws of Texas. Any disputes will be resolved in the courts of Bexar County, Texas. OverAssessed, LLC is a Texas limited liability company that provides property tax appeal services in multiple states including Texas, Georgia, Washington, Colorado, and Arizona.
11. Changes to Terms
We may update these Terms of Service from time to time. Continued use of our services after changes indicates acceptance of the new terms.
12. Professional Standards
Our services comply with applicable property tax codes and professional standards in each state where we operate, including the Texas Property Tax Code, Georgia Code Title 48, Washington RCW Chapter 84, Colorado Revised Statutes Title 39, and Arizona Revised Statutes Title 42. Fee rates vary by state (typically 25% of verified tax savings) and are disclosed in your Contingency Fee Agreement prior to engagement.
